WILL
A Will allows you to give direction on how your estate should be managed in the event of death. Your Will includes the appointment of an executor, beneficiaries, and guardians for your minor children. Your executor will ensure that your wishes are followed. Your beneficiaries will receive the assets of your estate. The guardian named in the Will takes care of your minor children.
ENDURING POWERS OF ATTORNEY
An Enduring Power of Attorney allows you to appoint someone to administer your finances and property if you become incapacitated, due to accident or illness. If you become incapacitated and do not have an Enduring Power of Attorney, someone would have to make an application to become your Trustee.
PERSONAL DIRECTIVES
A Personal Directive allows you to appoint someone to make personal decisions on your behalf
if you become incapacitated, due to accident or illness. A Personal Directive will take decisions
such as medical decisions, living and working arrangements, and end of life decisions.
PROBATE
APPLICATIONS
Probate is basically court approval of a Will. If the deceased individual has
significant assets with financial institutions or has real property other than property registered
as joint tenants, Probate will likely be required.
GRANT OF ADMINISTRATION
If the deceased individual did not have a Will, a person who wishes to take on the responsibilities of administering the estate, can apply for a Grant of Administration from the Surrogate Court in Alberta. Legislation will dictate how the Estate is distributed without a Wills.
